Browsing by access to or use of the web site and all the sub-domains and directories included in it, as well as the services or content you may obtain through it and all the sites owned under the name of WORDSINPROGRESS, SL, hereinafter LA PETITA, grants User status, through which you agree, by browsing the web page, to all the conditions of use established here, without detracting from application of the relevant regulations for obligatory legal fulfilment as appropriate. 

                Thus, if you do not agree with the conditions set forth in this legal notice, please do not use the site, as any use you may make of it or the services and content included in it, would imply acceptance of the legal terms set forth in this text.

LA PETITA’s web page provides a wide range of information, services and data. The user accepts responsibility for correct use of the web sites. That responsibility shall cover: the veracity and truth of the information provided by the user in the forms administered by LA PETITAfor access to certain content or services offered on the web.

Use of the information, services and data offered by LA PETITAshall not breach the provisions of these conditions, the Law, morals, good customs or public order, or any that may otherwise cause harm to the rights of third parties or operation of the web sites. To that end, the User shall abstain from using any of the content for illicit uses and purposes, prohibited in this text, harmful to the rights and interests of third parties, or that may in any way damage, hinder, overload, deteriorate or prevent normal use of the content, other Users or any Internet user (hardware and software).

LA PETITAaccepts no responsibility for damages or losses of any kind caused to the User due to failures or disconnection of telecommunications networks that cause suspension, cancellation, installation or interruption of the web service while it is being provided, or prior to such.

The web: http://www.lapetita.commay host advertising or sponsored content. The advertisers or sponsors are solely responsible for ensuring that the material sent for inclusion on the web complies with the laws that may be applicable in each case. 

LA PETITAshall not be held liable for any error, imprecision or irregularity advertising or sponsored content may contain. 

  1. AMENDMENTS

LA PETITA reserves the right to make the amendments it considers appropriate, without prior notice, to the content of its web sites, both to the content of such web sites as well as the conditions of use thereof, or the general contractual conditions. Such amendments may be made through its web sites, in any legally admissible way, and compliance shall be mandatory for the time they are published on the web and until they are amended by subsequent ones. 

  1. COOKIES RIGHTS

LA PETITA reserves the right to administer cookies to users browsing its web sites to facilitate customization and ease of browsing. Pursuant to the company data protection policy, LA PETITAhereby informs you that the cookies are linked to an anonymous user and to your computer, and they do not inherently provide the user’s name or surname.

In that sense, according to the judgment by the Grand Chamber of Justice of the Court of Justice of the European Union, on 1st October 2019, our cookies policy informs the user of the time the cookies shall remain active on the user’s terminal and of the possibility of third parties having access to the information stored there. This judgment amends Article 5, paragraph 3 of Directive 2002/58 to that of Directive 2009/136.

Based on that judgment, the user has the possibility of specifically accepting or refusing use of cookies. Moreover, the User is able to configure their browser to be informed of receipt of cookies, with the possibility, if they so wish, of preventing their installation on their hard disk. In that sense, cookies installation is not necessary in order to access the web sites of LA PETITA.

The user undertakes to abstain from reproducing, copying, distributing, making available or in any other way publicly communicating, transforming or modifying the Content, unless they have authorization from the holder of the relevant rights or if it is legally allowed.

  1. PERSONAL DATA PROTECTION

Pursuant to the terms established by the General Regulations EU-2016/679 of the Parliament and Council of Europe on Personal Data Protection, approved on 27th April 2016, andthe Spanish Organic Act on Data Protection (LOPD) 3/2018, to guarantee digital rights, LA PETITAinforms the users of its websites that we are bound to keep professional secrecy regarding the personal data gathered by the company through forms located on its pages. That obligation shall continue even after having concluded our commercial or contractual relation, and under no circumstance may we publish the personal data of the visitors and clients to the web without their consent. Children under the age of 14 years may not provide their consent for a business to collect and process their personal data; only their legal representatives (parents or guardians) may do so on their behalf. Businesses that need to process data on children under 14 years of age must provide the means to obtain consent from their parents or guardians, for example, by means of an electronic mail message addressed to any of them that contains a link to an electronic form. Children under the age of 14 years may not be asked for data regarding their family environment, the only exception being their identifying and contact data of their parents or guardians.

Such data shall be processed in an automated file under the control of the web administrator of LA PETITAin order to be able to facilitate, expedite and fulfil the commitments established between both parties. LA PETITAalso informs you of the possibility to exercise the rights of access, that allows the web user to know what personal data the administrator of this page has and, in such a case, it shall respond within a term of 30 days, as long as it holds such data; correction, that allows errors to be corrected, to amend data that is inexact or incomplete, and to guarantee the truth of the information, opposition that may be requested and obtained to ensure data processing is not carried out, suppression that allows deletion of inadequate or excessive data, limitation by which they may request limitation of processing their data when they have exercised their right to correction of their personal data, and portability so the user may obtain a copy of the personal data provided on the web in order to transmit such to other services. The intellectual and industrial property rights arising from all the texts, images, as well as the means and forms of presentation and assembly of their pages belong, themselves, or as assignee, to LA PETITA. They shall thus be works protected by intellectual property rights under Spanish law, and both the Spanish and EU laws may be applied to them in this field, as well as the international treaties on the matter subscribed by Spain, Royal Legislative Decree 1/1996.

All rights reserved. In fulfilment of the Intellectual Property Act, reproduction, distribution, public communication and use of all or part of the content of its web pages is specifically prohibited without specific consent from LA PETITA.

LA PETITAalso reserves the power to be able to file the civil or criminal actions it considers appropriate due to improper use of its web pages and content, or due to breach of these conditions.

The relations between the user and LA PETITAshall be governed by the Spanish laws in force and the competent courts to rule on any dispute that may arise between the user and LA PETITAshall be the Courts and Tribunals of the city of BARCELONA.
